State wise PG reservation after UG
On January 29, 2025, the Supreme Court ruled that State wise PG Reservation after UG for admission to NEET PG were unconstitutional. This implies that candidates will no longer be given precedence based on their state of origin; instead, all state quota seats must henceforth be filled exclusively based on the NEET PG merit list.
Reservation Requirements for NEET PG for 50% of All India Quota (AIQ) Seats in 2024: The 50% AIQ seats are administered by the Medical Counseling Committee (MCC). The reservation requirements for the 50% state quota seats are set by the approved counseling body in each state. Nevertheless, under the Supreme Court’s order, these seats must henceforth be distributed without regard to domicile and under the NEET PG merit list. All categories have a 5% horizontal reservation for Persons with Benchmark Disabilities (PwBD).
Validity of the State wise PG Reservation after UG
While the SC has maintained the state-level quota for the NEET UG exam, it has invalidated the domicile residence-based reservation for NEET PG. The court acknowledged that for undergraduate (MBBS) admissions, a certain amount of residency-based reserve might be permissible. It was adamant, though, that it would be unlawful to apply similar regulations to postgraduate medical schools, which demand knowledge and specialization.
According to the Supreme Court’s position on the subject, “Reservations at higher levels based on residence would be a violation of Article 14 of the Constitution, given the importance of specialized doctors in postgraduate medical courses.” For this reason, the court noted that while the domicile reservation quota at the undergraduate level is legal, it is invalid for specialized postgraduate medical programs.
